The Terms of Purchase govern any purchase you make on this website and apply in addition to the Terms of Conditions [click here to view]. The Terms and Conditions of this website and these Terms of Purchase constitute the entire agreement between you and Dyson with respect to this website and the purchase you have made through this website and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Dyson with respect to this website and any purchase you make through this website.

1. If you wish to purchase goods from the Dyson Store please follow the instructions provided in the Store section of this website.
2. Your electronic or telephone order is an offer to buy from Dyson. Dyson reserves the right not to accept an order at its sole discretion.
3. Once you have submitted an order, you will receive an automatic e-mail confirming the details of your order (name, address, product ordered, price, etc.). Such e-mail is a confirmation that the order has been received by Dyson and does not constitute acceptance of your order. Dyson reserves the right at any time after receipt of your order to accept or decline your order for any reason, regardless of whether your order has been confirmed or your credit card has been charged. If your order is declined or cancelled by Dyson after your credit card has been charged for the purchase, Dyson will promptly issue a credit to your credit card.
4. Payment for the goods you order must be made by MasterCard or Visa credit card. If your payment is rejected by the card issuer your order will not be dispatched. Payment is made at your own risk. All prices are in Canadian dollars.
5. The prices and availability of the goods displayed on this website are subject to change without notice. Prices are subject to all applicable taxes which are in addition to the listed price.
6. Orders will only be accepted from and dispatched to addresses within Canada. The order will be shipped to the shipping address indicated in the registration form using the shipping option chosen by Dyson. We cannot ship to a PO Box address. We apologize for the inconvenience.
7. Dyson fullsize vacuum cleaners are covered by a limited 5 year household warranty. Dyson handheld vacuums and Refurbs are covered by a limited 2 year household warranty. For details, please refer to Dyson Limited Warranty. OTHER THAN THE DYSON LIMITED WARRANTY AND TO THE EXTENT PERMITTED BY APPLICABLE LAWS, DYSON PROVIDES NO WARRANTY, CONDITION, REPRESENTATION AND GUARANTEE WITH RESPECT TO THE PRODUCTS THAT YOU PURCHASE ON THIS WEBSITE.
8. You may cancel your order by notifying Dyson in writing within 14 days of receiving the goods:
   1. by post to the address above, marked for the attention of Customer Service, or
   2. by fax to fax number [ 416-849-5822 ] marked for the attention of Customer Service, or
   3. by e-mail to service@dysoncanada.ca
9. You must then return the goods to Dyson at your expense. Note that if you fail to take reasonable care of the goods Dyson reserves the right not to accept their return and your payment will not be refunded. Dyson will refund the full purchase price to you within 30 days of the receipt of your notice of cancellation. As the goods are your responsibility until they reach us, we cannot be held responsible for goods lost or damaged in transit and we therefore recommend that you pack them carefully and obtain a proof of dispatch.
10. Dyson will notify you of any amendments to the Terms of Purchase in accordance with applicable laws.
11. IN NO EVENT SHALL DYSON, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, SUCCESSORS, ASSIGNS OR OTHER REPRESENTATIVES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DAMAGE TO PROPERTY, PERSONAL INJURY OR DEATH ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF PURCHASE OR ANY USE OF THE PRODUCTS THAT YOU PURCHASE THROUGH THIS WEBSITE, EVEN IF DYSON OR ITS REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, AND WITHOUT LIMITING THE FOREGOING, DYSON'S TOTAL CUMULATIVE LIABILITY TO YOU ARISING HEREUNDER SHALL BE AN AMOUNT NO GREATER THAN THE COSTS OF THE GOODS PURCHASED. THE LIMITATIONS ON DYSON'S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, OR CIVIL LIABILITY, OR BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. THE LIMITATIONS ON DYSON'S LIABILITY SHALL APPLY NOTWITHSTANDING THE BREACH OF A FUNDAMENTAL TERM OR CONDITION AND SHALL APPLY NOTWITHSTANDING ANY FUNDAMENTAL BREACH OF THESE TERMS AND CONDITIONS. DYSON CANNOT AND WILL NOT ASSUME ANY LIABILITY FOR UNAUTHORIZED OR FRAUDULENT USE OF THIS WEBSITE OR ANY PURCHASE MADE FRAUDULENTLY ON YOUR BEHALF.
12. The Terms of Purchase are governed and interpreted pursuant to the laws of Ontario, Canada and the federal laws of Canada applicable therein, notwithstanding any principles of conflicts of law. If any part of the Terms of Purchase is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining provisions. All waivers under these Terms of Purchase shall be in writing and signed by you and Dyson.
13. In the event of any inconsistency between these Terms of Purchase and the Terms and Conditions of this website, these Terms of Purchase shall prevail.
14. It is the express wish of the parties that these Terms of Puchase and all related documents be drawn up in English. C’est la volonté expresse des parties que cette convention de vente ainsi que tous les documents qui s’y rattachent soient rédigés en anglais.
